1. Service and Contracting Entity
AuditFlow is a security, privacy and compliance assessment and decision-support platform operated by Phoenix Cyber Audit in the Netherlands. AuditFlow provides automated assessment, findings, evidence-oriented reporting and prioritized action guidance.
2. Business and Professional Use
Commercial AuditFlow purchases are offered to businesses and professionals acting for business or professional purposes, not as consumers. A person making a purchase on behalf of an organisation confirms that they are authorised to do so.
3. No Legal Advice, Certification or Guarantee
AuditFlow outputs are decision-support materials. They do not constitute legal advice, regulatory certification, a formal audit opinion, penetration testing or a guarantee of compliance or security.
4. Customer Responsibilities and Authority
Customers are responsible for the accuracy and legality of information submitted to AuditFlow and for ensuring that they have authority to assess the websites, systems and documents they submit.
5. Automated Analysis
Assessments may use automated analysis and artificial intelligence. Results reflect the evidence and technical observations available at the time of analysis and should be reviewed by qualified personnel before material legal, security or business decisions are made.
6. Accounts and Security
Users are responsible for maintaining the confidentiality of account credentials and for activity performed through their accounts. Customers must provide accurate account and billing information.
7. Assessment Capacity
Paid packages provide the assessment capacity stated at the time of purchase. Assessment capacity is associated with the applicable AuditFlow account and is not a subscription or recurring monthly entitlement unless AuditFlow and the customer expressly agree otherwise in writing.
8. Free Trial
Where offered, the free trial provides the introductory assessment capacity stated on the applicable AuditFlow pricing page. Trial eligibility may be limited to one introductory trial per business.
9. One-Time Purchases, Payment and VAT
Unless expressly stated otherwise, commercial assessment packages are one-time purchases and do not renew automatically. Prices and applicable taxes are presented during the purchase process. VAT treatment may depend on customer location, tax status and applicable law.
10. Assessment Consumption
Assessment capacity is intended to be consumed when an assessment is successfully completed. If AuditFlow releases or restores reserved capacity because an assessment fails before successful completion, that capacity remains available to the account.
11. Refunds
Purchases are generally final once purchased assessment capacity has been activated or made available. A refund may be provided where required by applicable law or where AuditFlow is unable, due to its own service failure, to provide the purchased assessment capacity. Nothing in these Terms excludes rights that cannot lawfully be excluded.
12. Customer Content
Customers retain their rights in content they submit. Customers grant AuditFlow the limited rights necessary to process submitted content for providing, securing and operating the requested service.
13. Acceptable Use
Customers must not use AuditFlow unlawfully, interfere with the service, attempt unauthorised access, submit content they are not entitled to process, or use assessments against systems or information without appropriate authority.
14. Availability and Suspension
AuditFlow may maintain, change or temporarily suspend parts of the service when reasonably necessary for security, reliability, legal compliance or platform maintenance. Access may also be restricted where reasonably necessary to address misuse, security risk or a material breach of these Terms.
15. Intellectual Property
AuditFlow and its underlying software, interfaces, methods, branding and platform materials remain the intellectual property of Phoenix Cyber Audit or its applicable licensors. These Terms do not transfer ownership of the AuditFlow platform to the customer.
16. Confidentiality and Data Protection
AuditFlow handles personal data in accordance with its Privacy Policy. Each party remains responsible for confidentiality and data-protection obligations that apply to information under its control.
17. Third-Party Service Providers
AuditFlow relies on third-party infrastructure and service providers for functions such as hosting, authentication, payment processing and business communications. Relevant providers and data-processing information are described in the Privacy Policy where applicable.
18. Disclaimers and Liability
To the extent permitted by applicable law, AuditFlow is not responsible for decisions made solely in reliance on automated assessment results or for risks that were not observable from the evidence and technical information available to the service. Nothing in these Terms limits liability or statutory rights where such limitation is not permitted by applicable law.
19. Changes and Termination
AuditFlow may update these Terms when reasonably necessary to reflect service, legal or operational changes. Material changes will be presented through an appropriate service or website notice where required. Customers may stop using the service at any time, subject to obligations arising from purchases or use already made.
20. Governing Law, Contact and Disputes
These Terms are governed by the laws of the Netherlands, subject to any mandatory rules that apply. Questions, complaints or dispute notices may be sent to contact@auditflowapp.nl. The parties should first attempt in good faith to resolve a dispute directly before pursuing available formal remedies.
